1.1 Brokerage and Intermediary Status: Top Gun Cargo ("TGC") is acting solely as a platform broker, consulting firm, logistics coordinator, and transportation intermediary. TGC does not operate vessels, aircraft, trucks, warehouses, terminals, or other transportation assets and is not acting as a Non-Vessel Operating Common Carrier (NVOCC), ocean carrier, air carrier, motor carrier, or terminal operator. TGC's role is limited to consulting with and contracting on behalf of shippers and coordinating with qualified carriers, vendors, service providers, and logistics partners to perform requested services.
1.2 Platform Brokerage and Consulting Services: When arranging transportation, logistics, warehousing, fulfillment, customs, or related services, TGC acts solely as an independent platform broker and consulting firm facilitating agreements between the Shipper and the performing carrier, vendor, or service provider. The contract for the actual performance of services shall be between the Shipper and the applicable carrier, vendor, or service provider. Such services shall be governed by the applicable provider's terms and conditions, tariffs, service agreements, bills of lading, air waybills, warehouse receipts, and applicable laws. TGC assumes no responsibility or liability for the acts, omissions, performance, non-performance, negligence, insolvency, or misconduct of any third-party carrier, vendor, contractor, warehouse operator, terminal, customs authority, governmental agency, or other service provider.
1.3 Vendor Coordination Services: TGC may assist in sourcing, evaluating, coordinating, negotiating, and managing service providers on behalf of the Shipper. Any recommendations, introductions, quotations, or arrangements made by TGC are provided as a consulting and coordination service only. TGC does not guarantee the performance, availability, pricing, transit times, capacity, or results of any third-party provider and shall not be liable for any loss, damage, delay, shortage, detention, demurrage, penalties, fines, or other claims arising from services performed by third parties.
1.4 Scope of Solutions: Subject to the limitations and definitions set forth in Sections 1.1, 1.2, and 1.3, Top Gun Cargo provides international logistics solutions, including but not limited to Airfreight (NFO), Ocean Freight, Customs Brokerage, and Warehousing. All services are subject to availability and specific carrier regulations.
2.1 The Client is responsible for providing complete, accurate, and timely information regarding shipments, products, dimensions, weights, classifications, values, destinations, documentation, and any other information required for services performed by TGC. Top Gun Cargo does not verify the physical accuracy of data inputted by the user into the platform.
2.2 Quoted rates, estimates, and service fees are based upon the information provided by the Client and the conditions known at the time of quotation. TGC reserves the right to adjust rates, fees, surcharges, and service charges if any information provided is inaccurate, incomplete, misleading, or subsequently determined to be incorrect. Top Gun Cargo is not liable for delays, freight miscalculations, extra storage fees, or fines resulting from inaccurate information provided by the client.
2.3 Mandatory Payment Platform Usage: All payments, settlements, and financial transactions between the Client and TGC shall be processed exclusively through TGC’s designated platform and approved payment systems, unless otherwise expressly agreed in writing by TGC. No off-platform payments, credits, or settlements shall be considered valid or binding.
2.4 Invoice Compliance & Settlement: All receivables and client bills must be recorded, managed, and reconciled through the platform. TGC reserves the right to withhold processing or withhold shipment release for any transaction that fails to comply with established automated billing records, is inconsistent with platform parameters, or violates documentation requirements.

3.1 SMS Consent Communication: The information (Phone Numbers) obtained as part of the SMS consent process will not be shared with third parties for marketing purposes.

3.3 Message Frequency: Message frequency may vary depending on the type of communication and your active service requests.
3.4 Potential Fees: Standard message and data rates may apply, depending on your carrier’s pricing plan. These fees may vary if the message is sent domestically or internationally.
3.5 Opt-In Method: You may opt in to receive SMS messages from Top Gun Cargo by submitting an online form on our website.
3.6 Opt-Out Method: You can opt out of receiving SMS messages at any time. To do so, simply reply "STOP" to any SMS message you receive. Alternatively, you can contact us directly to request removal from our messaging list.

3.8 Standard Messaging Disclosures:
Carriers are not liable for delayed or undelivered messages.
4.1 Product Loss, Theft, and Damage: TGC shall not be liable for any loss, theft, damage, destruction, or deterioration of products, inventory, or shipments while in the possession, custody, or control of any carrier, vendor, warehouse operator, fulfillment partner, or other third-party service provider. Nothing in this Agreement shall be construed as creating a direct liability obligation on the part of TGC for product loss, theft, or damage.
4.2 Insurance & Contingency Measures: All carriers, vendors, and partners engaged by or through TGC are required to maintain appropriate insurance coverage and, where applicable, name TGC as an additional insured under their respective policies. In the event of loss or damage, claims shall first be submitted to the responsible third party and its insurance provider. As an additional contingency measure, TGC maintains Cargo Insurance coverage that may serve as a secondary benefit in certain circumstances where a valid claim is denied by the responsible third party’s insurance carrier. Such secondary coverage, if applicable, shall be subject to the terms, conditions, exclusions, deductibles, and limitations of the underlying insurance policy.
4.3 Operational Changes and Force Majeure: TGC reserves the right to modify rates, transit times, service commitments, or operational requirements due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, severe weather events, governmental actions, labor disruptions, transportation interruptions, force majeure events, market fluctuations, carrier-imposed surcharges, or other unforeseen conditions affecting the performance or cost of services.
